Three Tips For Having An Uncontested Divorce
Basically there are two different types of divorce: contested divorce and uncontested divorce.
In a contested divorce, the husband and the wife do not communicate well enough with each other to be able to negotiate a full agreement on each one of the major issues in the case. In the typcial contested divorce, both the husband and wife will ‘lawyer up’ and will engage in contested litigation down at their local court house.
In an uncontested divorce, the husband and the wife do communicate well and are able to use that communication to their advantage. So long as the husband and wife are able to negoitate a full agreement on each one of the major issues, they will be able to avoid having to ‘lawyer up’ and avoid engaging in contested litigation down at their local court house.
More specifically, in order to qualify for an uncontested divorce, the husband and wife must meet the following criteria:
- Both agree to the divorce and are willing to sign the paperwork that is drafted up by the lawyer
- Both agree on child custody
- Both agree on the division of property (real estate, vehicles, retirement accounts, bank accounts, etc.)
- Both agree on the division of debt (school loans, credit card debt, hospital bills, etc.)
- Neither husband or wife can be going through the bankruptcy process
